Rental Agreement

 

This Agreement (the "Agreement") is entered into between Island Baby Rentals, LLC  (referred to as "Drift") and the customer (referred to as "Customer") who rents childcare equipment from Drift. By renting childcare equipment from Drift, the Customer agrees to the following terms and conditions:

1. Rental Services:

Drift provides rental services for childcare equipment including but not limited to car seats, cribs, strollers, high chairs, and other travel needs. 

2. Insurance:

Drift is NOT responsible for providing insurance coverage for all rented equipment during the rental period.

3. Car Seat Installations:

Per Massachusetts state law, Drift is NOT responsible for car seat installations. It is the Customer's responsibility to ensure proper installation of car seats.

4. Excessive Soiling Fee:

If childcare equipment is returned with excessive soiling, a fee will be applied starting at $20. Excessive soiling includes, but is not limited to:

- Food and drink stains

- Melted candy or gum

- Ink stains

- Bodily fluids

- Stickers

- Other difficult-to-remove substances

5. Delivery Service:

Drift offers delivery services to Customers to all Martha’s Vineyard towns: Vineyard Haven, Oak Bluffs, Edgartown, West Tisbury, Aquinnah, Chilmark. Delivery fees may apply to same-day deliveries. 

6. Pick-Up Policy:

Customers are responsible for ensuring that rented equipment is accessible and ready for pick-up at the agreed-upon time. If equipment is left in an inaccessible location, additional fees may be applied.

7. Rental Period:

The rental period begins on the date of delivery and ends on the date of pick-up as agreed upon by both parties.

8. Reservation and Cancellation:

Customers are encouraged to make reservations in advance to ensure availability. Cancellations must be made at least 24 hours before the scheduled delivery time to receive a full refund. Cancellations made less than 24 hours before the scheduled delivery time may be subject to a cancellation fee.

9. Equipment Condition:

Customers are expected to return rented equipment in the same condition as it was received, with normal wear and tear accepted.

10. Liability:

 CUSTOMER BEARS THE SOLE RESPONSIBILITY FOR ANY ACCIDENT OR INJURY RESULTING FROM THE USE OF THE EQUIPMENT, AND AGREES TO HOLD DRIFT ABSOLUTELY HARMLESS IF ANY INJURY RESULTS FOR ANY REASON AS A RESULT OF THE USE OF THE EQUIPMENT.

11. Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts.

12. Amendments:

Drift reserves the right to amend these terms and conditions at any time. Customers will be notified of any changes to the Agreement.

By renting childcare equipment from Drift, the Customer acknowledges that they have read, understood, and agreed to abide by the terms and conditions SET FORTH in this Agreement.
